1. Who can use Sandy Gift

You must be at least 13 years old. To contribute money or receive payouts you must be legally able to hold and use the payment method involved.

You are responsible for your account and for keeping access to it secure.

2. Your content

You own what you post. You grant Sandy Gift a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your content within the service — that is what makes wishlists visible to friends.

Do not post content that is illegal, infringes others’ rights, or violates the conduct rules below. We may remove content and suspend accounts that do.

3. Funding, dibs and payouts

Contributions are gifts between users. They are voluntary and, once processed, are generally non-refundable — except where the law requires otherwise, or where these terms provide for a return, as they do when a gift is cancelled before its funds have been released to the recipient.

A contribution is a cash gift towards the item shown, not a purchase or escrow: the recipient chooses how to use it, and receiving contributions does not oblige them to buy the item.

Depending on the gift, a contribution is either paid directly into the recipient’s bank account, or collected by Sandy Gift and held as the recipient’s Sandy Gift Balance until the gift’s conditions are met. Which applies is shown on the gift before you contribute. A Sandy Gift Balance is not a wallet or a stored-value account: it can only ever hold proceeds of an identified gift or the return of your own contribution, it cannot be topped up, spent, or transferred to another person, and it can only be withdrawn to the account holder’s own verified South African bank account.

Payments are processed by Paystack. A fee is deducted from each contribution before it reaches the recipient. On gifts settled directly this is 5% on contributions of R100 or more, and 7.3% on smaller ones, where we cannot cover the cost of processing the payment out of our 5%. On gifts held as a Sandy Gift Balance it is always 5%, and we pay the processing cost out of our share. The exact split is shown before you contribute.

Where a gift is held as a Sandy Gift Balance, the recipient’s share becomes theirs when the gift reaches its target, or on its due date if the date arrives first. A gift set up now must carry a due date, and that date can be at most 30 days away; it can be moved later, but never past that same 30-day limit, and never earlier. It becomes available to withdraw once the underlying funds have settled with Paystack, which usually takes about two working days. Some older gifts have no due date, and one of those that never reaches its target stays pending until it is cancelled.

Payouts require a linked South African bank account in your own name. A withdrawal from a Sandy Gift Balance has a minimum and a transfer fee, both shown before you confirm; the fee is deducted from the amount you request rather than added to it. Payments take 2 to 5 days to clear into that account. You are responsible for any tax consequences of gifts you receive.

If a gift is cancelled before its funds have been released — including when the recipient closes their account — we return 95% of each contribution to the person who made it. The remaining 5% covers payment processing already incurred and is not refundable. If you have an account, the return is credited to your Sandy Gift Balance; if you contributed as a guest, it is refunded to the payment method you used.

“Dibs” is a social commitment, not a payment obligation — but repeatedly calling dibs without following through may lead to restrictions.

Sandy Gift is not a party to the gift: we provide the platform, not the goods. Sellers linked from posts are independent stores we do not control.

4. Conduct

No harassment, hate speech, threats, or impersonation. No spam, scams, or deceptive fundraising (for example, posting wishes you do not intend as wishes, or misrepresenting who receives funds). No sexual content involving minors — this results in immediate account termination and referral to authorities (see our Child Safety Standards). No attempts to interfere with the service, other accounts, or payments.

5. Advertising, sponsored content and data

Business accounts can pay to promote posts, which are labelled "Sponsored". Our use — including sale — of data derived from your activity is described in the Privacy Policy, which forms part of these terms.

If you are a company, brand, or are otherwise acting on behalf of a business, you must use a business account. Personal accounts are for personal wishlists: using one to advertise, promote or market products, services or a brand — your own or anyone else’s, whether or not you are paid for it — is prohibited, as is doing so to work around business account fees or the "Sponsored" label.

We may remove commercial content posted from a personal account, and restrict, convert or terminate the account. This does not stop you posting things you genuinely wish for, even when the seller is your own business — but Sandy Gift is not an advertising channel for personal accounts.

6. Termination

You can delete your account at any time in Settings. Before anything is deleted we show you exactly what money is affected: what you are owed and must withdraw first, and what will be returned to people who contributed to your unfunded gifts. Nothing moves until you confirm.

Deletion completes once that money is resolved — proceeds you are owed have reached your bank, and contributions on your cancelled gifts have been returned. Until then your account stays open in a restricted state so you can finish those withdrawals and follow their progress.

We may suspend or terminate accounts that violate these terms, create risk for other users, or where the law requires it. Funds already in payout flow are completed unless fraud is suspected. After deletion we anonymise your profile but keep the financial, fraud, tax and audit records we are required to retain.

7. Disclaimers and liability

Sandy Gift is provided "as is". To the maximum extent permitted by law we disclaim warranties and limit our liability to the amount of platform fees you paid us in the twelve months before a claim. Nothing in these terms limits liability that cannot be limited under applicable law.

8. General

These terms are governed by the laws of the Republic of South Africa. We may update them; material changes will be announced before they take effect.
